Designated Copyright & IP Agent Notice
RARE INC LTD (trading as TalkNote from Rare Inc.) responds promptly to valid notices of alleged copyright or trademark infringement under the US Digital Millennium Copyright Act (17 U.S.C. § 512), the UK Copyright, Designs and Patents Act 1988, and the EU Digital Services Act. Direct all IP notices to Support@rareincorporated.com.
1. Commitment to Intellectual Property Rights
RARE INC LTD ("Rare Inc.", "we", "us", or "our"), the operator of TalkNote from Rare Inc. ("TalkNote"), respects the intellectual property rights of creators, musicians, authors, broadcasters, and brand owners worldwide. We require all users of talknote.co, talknote.live, and the TalkNote iOS, iPadOS, and Android applications to do the same.
2. Audio, Music, and Voice Recording Copyright Rules
Because TalkNote is a social audio network built around spoken Voice Notes, audio comments, stories, and live audio broadcasts, special care must be taken with recorded sound:
- Original Voice Content: You retain full ownership of the original spoken-word Voice Notes, commentary, and media you create and publish on TalkNote.
- Commercial Music & Master Recordings: You may not upload, stream, or embed full-length commercial songs, unlicensed background music tracks, unreleased studio masters, DJ mixes, or copyrighted sound recordings unless you own both the underlying musical composition (publishing) and the sound recording (master) rights, or hold valid written synchronisation and public performance licences covering global distribution.
- Podcasts, Audiobooks & Broadcasts: You may not re-upload clips or episodes of third-party podcasts, audiobooks, radio broadcasts, sporting events, or paid subscriber audio without explicit authorisation from the rights holder, except to the extent protected by applicable statutory exceptions such as fair use (17 U.S.C. § 107) or fair dealing for criticism, review, or quotation under UK/EU law.
- Unauthorised Voice Cloning & Vocal Likeness: Uploading synthetic or AI-cloned audio that impersonates another individual's voice without their consent violates both this Policy and our Community Guidelines.
3. Submitting a Copyright Infringement (DMCA / CDPA) Takedown Notice
If you are a copyright owner—or an agent authorised to act on behalf of a copyright owner—and you believe that any Voice Note, audio comment, story, image, or profile element on TalkNote infringes your copyright, you may submit a written Notification of Claimed Infringement to our Designated Copyright Team at Support@rareincorporated.com or via our Support Center.
To be valid and actionable under 17 U.S.C. § 512(c)(3) and equivalent international standards, your written notice must include all six (6) of the following elements:
- Identification of the Copyrighted Work: A clear description of the copyrighted work(s) that you claim have been infringed (for example, title, artist/author, registration number if applicable, or a link to an authorised exemplar of the original work).
- Identification of the Infringing Material: Sufficient information to allow us to locate the allegedly infringing material on TalkNote, including the specific TalkNote URL (e.g.,
https://talknote.co/...orhttps://talknote.live/...), the poster's@handle, and/or the timestamp and description of the Voice Note, comment, or story. - Your Contact Information: Your full legal name, company or organisation (if applicable), physical mailing address, telephone number, and a valid email address where we can reach you.
- Good-Faith Statement: A statement that: "I have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law."
- Accuracy & Authority Statement Under Penalty of Perjury: A statement that: "The information in this notification is accurate, and under penalty of perjury, I am the owner, or an agent authorised to act on behalf of the owner, of an exclusive right that is allegedly infringed."
- Physical or Electronic Signature: A physical or electronic signature of the copyright owner or person authorised to act on their behalf (typing your full legal name at the bottom of your electronic submission satisfies this requirement).
Warning Regarding Misrepresentations: Under Section 512(f) of the DMCA and equivalent laws, any person who knowingly materially misrepresents that material or activity is infringing may be subject to legal liability for damages, including costs and legal fees.
4. How We Respond & Submitting a Counter-Notification
When RARE INC LTD receives a complete and valid copyright takedown notification, we promptly remove or disable public access to the allegedly infringing content, notify the user who posted it, and record the notice under our Repeat Infringer Policy.
Submitting a Counter-Notification: If your content was removed due to a copyright takedown notice and you believe in good faith that the removal resulted from mistake, misidentification, valid licence, or lawful fair use / fair dealing, you may submit a written Counter-Notification to Support@rareincorporated.com containing:
- Identification of the Removed Material: A description of the Voice Note, comment, or media that was removed and the location (URL or Note ID) where it appeared before removal.
- Statement Under Penalty of Perjury: A statement under penalty of perjury that: "I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
- Your Contact Details & Jurisdiction Consent: Your full legal name, physical address, telephone number, TalkNote
@handle, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, for any judicial district in which TalkNote or its service providers may be found, as well as the courts of England and Wales), and that you will accept service of process from the person who provided the original takedown notification or their agent. - Physical or Electronic Signature: Your physical or electronic signature.
5. Repeat Infringer Policy
In accordance with the DMCA and international copyright law, TalkNote from Rare Inc. maintains a strict policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat copyright or intellectual property infringers. We also reserve the right to suspend posting privileges or permanently terminate an account upon a single egregious violation of intellectual property rights.
6. Trademark, Brand Protection & TalkNote Intellectual Property
- Third-Party Trademarks: Users may not use another person's or company's registered trademark, trade name, or logo in a TalkNote
@handle, display name, profile avatar, or Voice Note in a manner that misleads or confuses others as to affiliation, sponsorship, or endorsement, or to promote counterfeit goods. Fan, commentary, or parody accounts must clearly state in both their display name and bio that they are unaffiliated. - Reporting Trademark Infringement: Trademark owners may report unauthorized trademark use to Support@rareincorporated.com by providing proof of trademark registration, the specific
@handleor URL at issue, an explanation of likelihood of confusion, and a signed statement of authority. - TalkNote Trademarks: The TalkNote name, the TalkNote from Rare Inc. wordmark, the TalkNote waveform and badge logos, the
talknote.coandtalknote.livedomains, and the proprietary user interface designs of our mobile and web applications are the exclusive intellectual property of RARE INC LTD.
